The Fresh Start Program is not one program
You have probably heard ads promising the “IRS Fresh Start Program” will wipe out your tax debt. That is not what it is. In February 2011 the IRS announced a series of changes to its collection rules and called them a “fresh start” (IRS news release IR-2011-20). There is no application that forgives your balance. What exists is a set of IRS rules that can make a tax debt easier to resolve, if your case fits them.
What the IRS changed:
- Fewer tax liens. The IRS raised the balance at which it generally files a Notice of Federal Tax Lien. Its manual now uses a $10,000 unpaid balance as the lien-filing threshold (IRM 5.12.2).
- Lien withdrawal with a payment plan. If you owe $25,000 or less and pay by Direct Debit Installment Agreement, the IRS may withdraw a filed lien (IRC 6323(j); Form 12277).
- Payment plans without a financial statement. If you owe $50,000 or less and the plan pays the balance in full, with penalties and interest, before the IRS collection deadline, the IRS can approve it without a Collection Information Statement (IRM 5.14.5.2). Business payroll tax balances qualify up to $25,000 (IRM 5.14.5.4), and income tax of $10,000 or less may qualify for a guaranteed agreement (IRC 6159(c)). Above these amounts, the IRS generally requires a full financial statement.
- Offer in compromise. The IRS expanded the offer program, which settles a tax debt for less than the full amount when you cannot pay it in full.

- Decide which option fits: a payment plan, lien withdrawal, an offer in compromise, or another IRS remedy.
- Bring any unfiled returns current, since most options require it.

Be careful with “Fresh Start” ads
Companies that promise to settle your debt for “pennies on the dollar” before they have seen your IRS records are guessing. No one can promise an outcome before reviewing your account.
