There is no IRS “tax forgiveness program”
Ads promise the IRS will forgive your tax debt if you call now. The IRS has no program by that name. What it does have are specific rules that can lower or end a tax debt when your situation fits them. Knowing which one applies to you is the whole job, and it is our job.
The real ways a tax debt gets reduced
- Offer in compromise. Settles your tax debt for less than the full amount when you cannot pay it in full or paying would create a financial hardship. The IRS looks at your income, expenses and asset equity, and generally accepts an offer when it is the most it can expect to collect within a reasonable time. You must have filed all required returns and cannot be in an open bankruptcy. The application fee is $205, non-refundable.
- Penalty relief. Penalties can be a large part of what you owe. First Time Abate can remove failure-to-file, failure-to-pay and failure-to-deposit penalties if you have a clean three-year compliance history. If you do not qualify, relief may still be available for reasonable cause. When a penalty is removed, the interest on that penalty is reduced or removed with it. Starting with 2025 tax-year returns and 2026 quarterly returns, the IRS’s new Automatic Exemption from Penalty skips the failure-to-file, failure-to-pay and failure-to-deposit penalties automatically if you filed and paid on time for the three prior years. We confirm it was applied and request relief for earlier years.
- The 10-year collection limit. The IRS generally has 10 years from the date a tax was assessed to collect it (IRC 6502). Payment plan requests, offers, bankruptcy and some appeals pause or extend that clock. We calculate the actual deadline on each of your tax years before choosing a strategy.
- Innocent spouse relief. If the debt comes from a joint return and your spouse or former spouse caused it, you may be relieved of your share (IRC 6015).
- Bankruptcy. Some older income taxes can be discharged in bankruptcy, but only when strict timing rules are met (11 U.S.C. 507(a)(8) and 523(a)(1)). Payroll trust fund taxes cannot be. We review which of your years qualify and work alongside your bankruptcy attorney.
- Currently not collectible status. Not forgiveness. If you cannot pay because of financial hardship, the IRS may temporarily suspend most collection. You still owe the full balance, and penalties and interest keep adding up, so we pair it with the options above where we can.
